The beyond reasonable doubt is very crucial before the release of the verdict of the judge to the allegedly responsible of the crime. A belief that should proven that there is no small remaining doubt due to the releasing of judge decision is the most important either the suspected criminal is guilty or not.

If the jury released the decision that the allegedly criminal was guilty does it mean that the criminal is convicted beyond reasonable doubt which means that the suspected criminal is the real creator of the crime?

When in his trial, the evidence DNA was mismatch to the suspected criminal and the witness proven by the defendant that not reliable to become a witness due to some contradictions to the testimony in court before and there was no sufficient evidence to prove that the A was the real creator of the crime.

The contradiction of the testimony of the witness makes the jury doubt that there is something not right and the DNA was mismatched to the suspected criminal.

In this case, the defendant’s party files the demurrer of evidence due to insufficient of evidence.

 The court upon discretion without filing of demurrer of evidence in court shall dismiss the case motu proprio and those evidences against to the defendant cannot convince the court beyond reasonable doubt.

The beyond reasonable doubt is the most important factor to determine that the defendant of the case is guilty, if the evidence is weak and no sufficient power to convince the jury, in that instances cannot prove beyond reasonable doubt and the defendant will acquit.
