Corpus Delicti

Corpus Delicti defined as a body of the crime which is important in convicting the malefactor of the case, without the corpus delicti, it is impossible to convict the criminal due to the crime must prove first before charging of an offense. 

The evidence can be say is the means to prove the corpus delicti; without the evidence it seems there is no crime happened. If there is no crime committed there is nothing corpus delicti at all.

 The crime scene has great role to prove that there is corpus delicti. The crime scene must preserve to prove the responsibility of allegedly criminal as the body of the crime or known as the corpus delicti.

How can you charge a person of an offense or a simple breach of law if there is no crime? 

Charging of an offense without crime is impossible, if there is no crime due to there is no law yet that punish those acts even the acts are something not right but if there is no law yet to charge as a crime, therefore there is no crime and there is no corpus delicti at all.

If you do not understand yet the meaning and where the idea is fit; just remember the corpus delicti is with the crime; but don’t put in your mind that the crime is a corpus delicti; the corpus delicti is just a body of the crime. The corpus delicti is not the branch or the root of the crime but the body of the crime.

Prove first that the crime was committed or there is a violation of law before the conviction or jury release the verdict. This is the important to prove that the criminal is guilty of violation of law either crimes against person, property or even crimes against nature should that the crime must prove known as the corpus delicti. 

Corpus Delicti in Robbery Case

Not all crimes are against person but there was also called crime against property wherein the violation of law defined the robbery case and how to determine the corpus delicti in robbery case.

Even the case especially in the robbery case the act was in flagrante delicto wherein the suspected criminal was caught in the act still needed to prove if there is corpus delicti in robbery case if the violation of law was under the case of robbery. This attestation was challenged the truthfulness of law enforcers those caught the suspected criminal. Questions that need to answer of law enforcers if the arrest is valid, if there is fact of the case wherein there is a crime and what law that violated the acts of allegedly criminal. Is it there was robbery incident?

Corpus Delicti in Rape Case

The rape are the common crimes those the victims are women, the corpus delicti in rape case should prove first if there was crime happened in rape, if the aggravated party was telling the truth or just razing the life of allegedly malefactor of the case. There were many incidents those filing of complaints against John Doe by Jane Doe. The evidence against John Doe must proven first as for convincing the jury that the case is real or just fabrication to raze the life of John Doe.

There are laws that the husband may charge rape if the wife was forced to sex if against her will, the best example in that law is the Philippines law. 

Corpus Delicti in Murder Case

The corpus delicti in murder case is same to the other above mentioned that need to prove if the murder incident was happened and not a fabricated case. Some cases in murders would manipulated by the allegedly criminal to avoid detection that may led them into apprehension in the future as consequence of the mistake to the other people or person. 

They destroyed the crime scene to mislead the justice, we can call it as modus as well. The modus as we know in the direct translation was the method.
